Terms of Service

These Terms of Service ("Terms") govern your use of the LaunchOpenClaw platform operated by GazelleLabs LLC ("we", "us", or "our"). By using LaunchOpenClaw, you agree to these Terms.

1. Service Description

LaunchOpenClaw is a platform that provisions and manages dedicated cloud virtual machine instances running the OpenClaw AI assistant. We provide the infrastructure and management layer; the OpenClaw software is an open-source project with its own license.

2. Accounts

You must sign in with a Google account to use LaunchOpenClaw. You are responsible for maintaining the security of your account. You must not share your account or allow others to access it. You must be at least 18 years old to use this service.

3. Subscriptions and Payments

Access to VM instances requires a paid subscription. Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

  • Billing Cycle: Subscriptions renew automatically each month on the anniversary of your start date.
  • Price Changes: We may change subscription prices with 30 days' notice. Existing subscriptions remain at their current price until the next renewal after the notice period.
  • Cancellation: You may cancel your subscription at any time through the billing portal. Access continues until the end of your current billing period.
  • Refunds: We do not offer refunds for partial billing periods. If you experience a service outage, contact us to discuss credit.
  • Grace Period: If a payment fails, you have a 14-day grace period during which your VM remains accessible. After this period, your VM will be stopped.

4. Acceptable Use

You agree not to use LaunchOpenClaw to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Distribute malware or engage in malicious activities
  • Attempt to gain unauthorized access to our systems or other users' instances
  • Use the service for cryptocurrency mining
  • Send spam or unsolicited communications through your VM instance
  • Store or transmit illegal content

We reserve the right to suspend or terminate accounts that violate these terms without notice.

5. VM Instances

Each subscription tier provides a dedicated VM with specific resource allocations. We manage the underlying infrastructure but you are responsible for the data and configurations within your instance.

  • Data: You retain ownership of all data stored on your VM instance. We do not access your instance data except when required for maintenance or as required by law.
  • Backups: We do not provide automatic backups of your VM data. You are responsible for backing up any important data.
  • Deletion: When your subscription ends (after the grace period), your VM instance and all associated data will be permanently deleted.

6. API Keys

You may provide API keys for third-party LLM providers (OpenAI, Anthropic, Google) to use with your OpenClaw instance. You are responsible for the usage and costs associated with those API keys. We encrypt your keys at rest but are not liable for charges incurred through your keys.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We are not liable for downtime caused by Google Cloud Platform outages or other factors beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, GazelleLabs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of LaunchOpenClaw.

Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Disclaimer of Warranties

LaunchOpenClaw is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the platform at least 30 days before the changes take effect. Continued use of the service constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
